I am an activist for marijuana law reform. Some think automatically that this makes me a criminal by association. That is just one of many warped views out there today. My goal is to educate the public on a grass roots level and to hopefully get a conversation going in the right direction with South Carolina legislature about reforming the marijuana laws for SC. This is step one. Disclaimer: In no way does this blog or myself advocate breaking the law.

Real World Ramifications of Cannabis Legalization and Decriminalization
The following paper reviews various studies** that have examined this issue in regions that have either a) regulated marijuana use and sales for all adults; b) decriminalized the possession of small quantities of marijuana for adults; c) medicalized the use of marijuana to certain authorized individuals; or d) deprioritized the enforcement of marijuana laws. This paper also proposes general guidelines to govern marijuana use, production, and distribution in a legal, regulated manner.

Gallup: Record Percentage Of Americans Now Support Marijuana Legalization
Princeton, NJ: A record 50 percent of Americans now believe that marijuana ought to be legalized for adult use, according to a nationwide Gallup poll of 1,005 adults.
The percentage of Americans favoring legalization is up four percent from 2010. It is the highest percentage ever recorded by Gallup, which has tracked public opinion data regarding marijuana policy since 1969.
The 2011 survey results also mark the first time ever that Gallup has reported that more Americans support legalizing cannabis (50 percent) than oppose it (46 percent).
Gallup reported that support for legalizing cannabis was highest among self-described liberals (69 percent) and those between the ages of 18 to 29 (62 percent). Support was weakest among Republicans (35 percent), self-described conservatives (34 percent), and those over the age of 65 (31 percent)."

California: State's Largest Doctor's Association Calls For Legalizing And Regulating Cannabis
Sacramento, CA: The California Medical Association (CMA), representing over 35,000 physicians nationwide, has called for the 'legalization and regulation' of cannabis for adults, according to a white paper adopted by the group on Friday.
The CMA paper, entitled 'Cannabis and the Regulatory Void,' recommends that cannabis be taxed and regulated "in a manner similar to alcohol." The paper also calls for the reclassification of cannabis under federal law "in order to encourage research leading to responsible regulation."
It states: "In order to allow for a robust regulatory scheme to be developed, cannabis must be moved out of its current Schedule I status. ... Rescheduling cannabis will allow for further clinical research to determine the utility and risks of cannabis, which will then shape the national regulatory structure for this substance.""

NORML.ORG US CO: Three Operators Of Denver Medical-Pot Operation Charged
Colorado
-------
The charging of three medical-marijuana entrepreneurs with federal drug crimes sowed chaos in the state's cannabis community Friday and raised questions about why the owners' dispensary was allowed to stay open after a previous police raid.
Father-and-son Ha and Nathan Do were in federal lockup on drug-distribution charges Friday night, held without bail, after agents raided an unlicensed marijuana-growing warehouse in Denver and seized more than 1,000 cannabis plants. Along with Ha Do's brother, Hai Do, the three run the Earth's Medicine dispensary in Denver and operate three cultivation facilities that have applied for licenses, according to state records.
Hai Do and Richard Crosse, the owner of the raided warehouse, were also charged with drug distribution but have not yet been arrested. "

The four U.S. attorneys in California announced last week yet another federal marijuana program, with this one aimed at closing down medical marijuana dispensaries. South Carolina High School Issues Ban On Hemp Jewelry
Students attending Spring Valley High School may no longer wear necklaces made out of hemp fiber, according to a new policy enacted by educators this year. Administrators at the school said the ban was necessary because the necklaces are representative of the marijuana drug culture.
"School officials' purpose for banning hemp jewelry likely violates students' constitutionally protected rights to speech," said Tanya Kangas, Esq., director of litigation for The NORML Foundation.
Steven Bates, executive director of the state American Civil Liberties Union (ACLU), also voiced opposition to the new policy. "The authoritarian nature of schools is becoming ridiculous," he said. "It's silly. You could smoke it (hemp) all day long and not get high.""

NORML Chapter To File Suit Over Free Speech Restriction
Columbia, SC: The South Carolina chapter of the American Civil Liberties Union (ACLU) is suing organizers of the state's largest annual music festival to allow representatives from Midlands NORML to distribute promotional materials at this weekend's Three Rivers Music Festival.
Event organizers initially rejected Midlands NORML's application to host a booth at the festival because they disapproved of the group's literature - which argues for reforming marijuana prohibition. After receiving letters from the ACLU, Three Rivers Music Festival representatives agreed to grant Midlands NORML a booth at the event, but said that the group could not freely distribute their written materials to festival attendees."

Legalize and Regulate Marijuana in a Manner Similar to Alcohol.
We the people want to know when we can have our “perfectly legitimate” discussion on marijuana legalization. Marijuana growers to face more jail than child rapists under Harper’s new omnibus bill - Exposing The Truth
Under the Tories’ omnibus crime legislation tabled Tuesday, a person growing 201 pot plants in a rental unit would receive a longer mandatory sentence than someone who rapes a toddler or forces a five-year-old to have sex with an animal.
Producing six to 200 pot plants nets an automatic six-month sentence, with an extra three months if it’s done in a rental or is deemed a public-safety hazard. Growing 201 to 500 plants brings a one-year sentence, or 1 1/2 years if it’s in a rental or poses a safety risk."

With only 61-66% of homicide cases in this country cleared every year, and only 12% of burglaries cleared, it’s not surprising that voters think police should have more important things to do than arresting individuals who possess a substance safer than alcohol. The criminal case of accused Sinaloa drug organization leader Jesus Vicente Zambada Niebla is straying even further into the path of a cover-up under the guise of national security, if pleadings filed by his attorneys are to be believed.
Lawyers for the alleged Mexican narco-trafficker, son of one of the top figures in the Sinaloa “cartel,” recently filed a motion asking the court to block U.S. prosecutors’ efforts to exclude the defense from discussions with the judge over the treatment of evidence deemed classified material. Zambada Niebla’s attorneys contend they must be part of those discussions since the supposed classified material goes to the heart of their client's claims in the case."

Task Force raid yields $30k, vacuum sealing supplies - Ukiah Daily Journal
The Daily Journal
Following up on reports that someone was selling marijuana out of a hotel room on South Main Street in Willits, Mendocino Major Crimes Task Force agents cited a Colorado man for his alleged involvement in shipping marijuana to his home state for sales.
The Task Force served a search warrant Wednesday in room 301 of the Best Western and found about a quarter-pound of pot that was "indicative of samples," according to MMCTF Commander Bob Nishiyama.
Francisco Torrealba, 38, of Denver, Colo., allegedly said he had bought $3,000 of pot locally that hadn't yet been delivered, but didn't reveal where he purchased it, according to Nishiyama.
Also found in the hotel room was just less than $30,000 cash, he said.
Two people were also detained outside the room with two large duffel bags found to contain 20 to 30 bags and vacuum sealing equipment, according to Nishiyama."

During the span of a few weeks last fall, Dr. Colin Kane, a pediatric cardiologist at Children’s Medical Center in Dallas, was surprised when the teens, all aged 16, were admitted with chest pain. Distressingly, the Obama White House seems determined to paint itself into a corner of prohibitionist law enforcement
The murky doings of the hacker group Anonymous took a remarkable turn in recent days. A Mexican drug cartel allegedly kidnapped an Anonymous member, and then, after the loosely organised hackers said they would reveal names of cartel personnel, released him with threats to kill the hacker's family if the names were revealed.
The affair, which played out in blogs and on Twitter, coincided with a week I spent in central Mexico, where I led several workshops for new-media creators. In conversations with a number of people during my visit, I got a clearer understanding of the fear that pervades Mexican society – an undercurrent that also combined despair and anger at the way the cartels have corrupted the country's institutions.

People v. Laura J. Kriho — 96 CR 91 First Judicial District — Gilpin County
http://www.dvmen.org/Cases/96CR91_1Nieto_Kriho.htm
History
This case began on May 13, 1996, when Laura Kriho of Rollinsville, Colorado, a Colorado University researcher, was selected to sit on a jury to hear the criminal trial of 19-year-old Michelle Brannon in the district court of tiny Gilpin County. Brannon was accused of felony possession of methamphetamine, a schedule II controlled substance, criminal impersonation, and unlawful possession of drug paraphernalia. Kriho was the twelfth juror seated. Jurors seated earlier were subjected to extensive voir dire questioning. However, it was late in the day. When asked by Judge Kenneth Barnhill the sole question, "Is there anything, whether I asked it or not, that you can think of that would interfere with your sitting as a fair and impartial juror," she replied, "No." She truthfully could not think of a reason why she could not serve the interests of justice in the case.
What went unasked and unanswered was that twelve years earlier Ms. Kriho had received a deferred sentence on a minor possession drug charge (see Appendix A). Upon the successful completion of two-year probation and 40 hours of community service the charges against her were supposedly dismissed. But, as in all such cases, the charges were still in official records (see COcourts.com) and Appendix A.
The trial lasted two days, after which the jury began its deliberations. Apparently the jury quickly reached a verdict on the criminal impersonation and drug paraphernalia charges but after a mere four hours they could not agree on the possession charge. It seems Laura Kriho was the lone holdout.
